Concealed Carry Bill Gets Support from 3 NJ House Members

It would eviscerate state gun laws and make it easy for people with unsafe histories and no training to carry hidden, loaded guns in public across the country. The US House Judiciary Committee [official website] approved the bill late last month despite severe opposition to the bill from 17 states [JURIST report].

The House passed a bill December 6 that would make permits to carry a concealed weapon issued in one state valid in all other states, similarly to how driver's licenses are recognized across state lines.

Combining these bills will be sacrificing actual progress for public safety in order to undermine state gun laws across the country. We wouldn't recommend holding your breathe in hopes of a quick ruling, however.

This is the first movement by lawmakers under Trump to fulfill the president's campaign promises to promote and protect gun rights.

The measure would allow gun owners with a state-issued concealed-carry permit to carry a handgun in any state that allows concealed weapons.

A House bill passed late Wednesday to expand the right to carry concealed weapons drew condemnation from New York Democrats, while upstate Republicans supported the measure. As the New York Times' article explained, "Some states ... require that permit applicants have live-fire experience and safety training, along with a clean criminal history".

Congress should reject Concealed Carry Reciprocity, and pass a clean "Fix NICS Act", which has won wide bipartisan support, will improve reporting of risky people to the National Instant Criminal Background Check System, and will improve safety of communities across the country.

Through the now existing system, states are free to issue their own concealed carry permits and choose which other state's permits they want to recognize.

The bill would make concealed carry licenses in one state valid across state lines.

"This section shall not be construed to supersede or limit the laws of any state that permit private persons or entities to prohibit or restrict the possession of concealed firearms on their property, or prohibit or restrict the possession of firearms on any state or local government property, installation, building, base, or park". In some of these states, according to Schumer, concealed carry permits have been legally issued to convicted felons.

So even if the Concealed Carry Reciprocity Act becomes law, states would be free to ban the carry of guns in school zones, said Adam Winkler, law professor at the University of California, Los Angeles. Named for Michael Boeglin, a 31 year old owner-operator who was shot to death while waiting to pick up a load in Detroit in 2014, Mike's Law called for nationwide hide and carry reciprocity for truck drivers on the job.
